What is Sexual Harassment?
Sexual harassment is, generally, defined as an inappropriate request for sexual favors or unwelcome physical conducts or bullying of sexual nature. However, in order to take sexual harassment crime and civil wrong more seriously we must better understand its true meaning in context of its occurrence.
As defined above, Sexual harassment involves unwelcome sexual advances, which can be either oral or written words or physical conducts. Such behaviors could be obvious and clearly understood as touching, caressing, patting, groping, pinching or clear words as “Nice Butt” or “Nice Bulge” and other inappropriate remarks. They can also be subtle behaviors such as leering, glaring or staring.
It is important to know that not all inappropriate comments or unwanted touches are considered illegal sexual harassment. For instance an inappropriate comment from a co-worker at the office holiday party or a creepy glance may be crude, rude and unwelcome, but not necessarily reach low enough to the level of Sexual Harassment.
While the culprit of such unwelcome words and conducts may be held liable under Assault and/or Battery (Criminal and Civil Liability), they may not be construed as sexual harassment unless the victim takes certain actions such as simply telling the harasser to stop: lest it can be proven that the victim was afraid of retaliation and other hardships.
In the context of employment, the harasser can be a supervisor, a co-worker, a client or a customer, who requests inappropriate sexual demands such as:
1. Making sexual conduct a condition of individual’s employment. This demand could be implicit or explicit.
2. Conducts that affect or unreasonably interfere with an individual’s job performance or it creates a hostile, intimidating and offensive work place and so on.
As mentioned above, in order for the court to find sexual harassment, it is not always necessary that the victim says or behaves in a particular way to prove the unwanted act. The court generally reviews all of the attendant circumstances to determine, whether a reasonable person in victim’s stead would feel comfortable to overtly object to the inappropriate conduct or words.
Sexual harassment can take place anywhere: in public, at school, at work, or even at home.
Same-Sex Sexual Harassment
Traditionally Sexual Harassment was associated with heterosexual people making unwelcome sexual advances on other heterosexual persons. Today in most jurisdictions Sexual Harassment is clearly against the law regardless of gender and sexual orientation of the parties. Therefore, a homosexual person could be found guilty of harassing another homosexual or heterosexual person.
