Law center helps defend open source

Eben Moglen, Columbia University Law Professor, will head the newSoftware Freedom Law Center (SFLC). An initial 4 million dollars has been provided by Open Source Development Labs (OSDL) to fund the project.

The law center will provide free legal service for open source projects and developers. In 2004 OSDL established a separate $10 million Linux Legal Defense Fund providing legal support for Linus Torvalds, Linux kernel creator and end user companies subjected to Linux-related litigation by the SCO Group. The new law center will not be affiliated with the OSDL.

“This is about taking care of the goose that laid the golden egg and not letting wolves come in the middle of the night and steal it away,” Moglen said during a press conference. “This is a legal firm not involved so much in litigating and defending as it will be for counseling and advising and nurturing non-profits and to prevent millions of dollars in litigation.”

Moglen will serve as chairman and director-counsel of the non-profit organization. Also on board as directors are: Lawrence Lessig, law professor at Stanford Law School; Daniel Weitzner, director of the World Wide Web Consortium‘s technology and society activities; and Diane Peters, general counsel at the OSDL. Daniel Ravicher, executive director of the Public Patent Foundation, will help manage as legal director.

Moglen, one of the world.s leading experts on copyright law as applied to software, will run the new Law Center from its headquarters in New York City. The Law Center will initially have two full-time intellectual property attorneys on staff and expects to expand to four attorneys later this year. Initial clients for the Law Center include the Free Software Foundation and the Samba Project.

Other services provided by the SFLC include: asset stewardship, to avoid intellectual property claim conflict; license review and compatibility analysis; legal consulting and lawyer training.

In addition, they obtain enough knowledge to run their own business should they choose to be self-employed. This is achieved through a comprehensive curriculum that incorporates anatomy, physiology, practical applications, product knowledge, sales techniques and business practice. The esthetics college program curriculum also combines the use of lectures and Centennial Colleges brand new esthetician lab facilities and cutting-edge equipment that is common in todays wellness and medical spas. Specific courses within the program include: Skin Care Theory, Skin Care Practices, Manicures and Pedicures, Spa Health and Safety, Waxing and Hair Removal, Product Chemistry and Advanced Experience, and more. The in-class sessions are designed to prepare students for Centennial Colleges esthetician field placement, during which students work in esthetics establishments. During their field placements, students work with real customers (under the supervision of their instructors), learning the ins and outs of the industry. Please be advised, that students must have completed a standard first aid and CPR (healthcare provider level) course, a vulnerable sector background police check, and an immunization review form before they can be sent out on the esthetician work placement. Graduates of this esthetics college program possess the ability to: perform a variety of specialized body and skin care treatments following correct procedures and precautions; use a range of specialized equipment and products; select and recommend the use of esthetic products and product ingredients to clients, taking into account health status and identified needs; develop customer service strategies that meet and adapt to individual needs and expectations; adhere to health, safety, sanitation and infection prevention control guidelines; and more.

Book Fair 2.0; On bloggers, ebooks and pirates

The Internet is very much present at the Frankfurt Book Fair 2007, not just, like in previous years, as a means for the journalists who have 80 workplaces for their own notebooks to report on the fair, but like before as a chance – and as a threat for rights-owners of digital media.

After a marginal existence in the previous year, bloggers have got their own “living room 2.0” at the fair, furnished with everything a blogger needs, including media attention. Every day from Wednesday October 10 to Sunday October 14 they will write and podcast about the big names to meet, the events not to be missed and their very personal experiences and thoughts. Three of the bloggers write in English, two English language podcasts are done, to widen the reach of the Book Fair 2.0. The blog entries and podcasts will be available until after the book fair at http://www.book-fair.com/en/wordpress/ and the bloggers themselves can be visited on the weekend at hall 4.2, Q411, though until now it is more the media and less the visitors of the fair, the bloggers come in contact with.

Digitalization and digital media, especially books and magazines offered digitally, are a hot topic at this year’s Frankfurt Book Fair, as more and more publishers want to see the digital counterparts of their traditional media not just as a field to be present in, but as a possible profit center. With scientific books, this move already was quite successful: Publishing house Springer for example, offering over 40,000 ebooks and over 1700 electronic magazines, of which over 1200 are still actively continued with Springer, nowadays does an ebook-variant of every traditional scientific book they print – and already has the largest part of their cash-flow from digital media.

This is harder for fiction publishing houses as the Pabel Möwig group (VPM), which has become active early. They do offer the digitized new adventures of – say, the outer-space-hero Perry Rhodan -, but the turnover is still only a small addition to the print and other media versions. Readers become readier to read on a screen, but their readiness is still growing slowly. Since a new generation of readers is growing up using the internet as a reference work – especially Google and Wikipedia – it will become more and more natural in the future.

A growing number of service companies in the publishing sector therefore offers re-digitalization apart from increasingly effective content management systems, with which new forms of media can easily be compiled from the contents of a data base.

Older works, of which the publishing house owns the rights, but for which a reprint might not be profitable, are scanned, divided into content sections and tagged. When the original type face isn’t good enough, books are typewritten in third world countries two or three times which are corrected and merged into a final version. Once in the system, digitalized books can be at disposal as MobiPocket ebooks or Print On Demand (POD) and with aid of the Amazon BookSurge program remain available, possibly even within 24 hours.

Digital content can also be used as a marketing-tool with the “Search Inside” from Amazon.com, where the full text of a book is visible but only small parts of the book are shown at a time.

Right after Amazon, Google also presented their own projects for the digitalization of books, where publishers have the option of just sending a box or container full of their books in printed form and leave the job of digitalization to Google, where afterwards their content will be findable with Google Book Search. The difference between those two internet services was obvious, though: Amazon wants to earn money with books, while Google’s business is advertising, their revenue model is AdSense and AdWords, targeted as perfect as possible with full text search. Both services had to answer questions as to how they will protect the content from unpaid exploitation, as probably fewer and fewer users will be willing to pay for a digital eBook when they can read the content for free, up to twenty pages at a time. The freeloader mentality of many Internet users was seen as a threat by many of the publishers.

Four-year-old boy attacked by Pit bull mix

Just before midnight Wednesday, four-year-old Taylor Bailey, nicknamed Bucky, was attacked by a neighbor’s dog. The Staffordshire Bull Terrier mix named Money chased the boy after he stepped out of his mother’s car, eventually knocking the boy to the ground and latching onto his leg.

The same dog had bitten the boy’s father the week before, according to the family, although this has not been confirmed by police. He recognized the dog and alerted his mother to the dogs presence just moments before the attack. She urged her son to come to her, but the one-year-old, 85-pound (~39 kg) male broke free from his restraints and attacked the screaming boy.

The struggle lasted several minutes before the boy’s mother, Melinda Walters, was able to fight off the dog, leaving her knees scraped and thigh scratched. The boy’s legs were punctured, scratched and bruised with bits of flesh missing. “It didn’t go away. It was just trying to grab me … trying to kill me,” the boy said. Walters was carrying her three-year-old son Jason on her hip during much of the fight.

The dog’s owner, Marquita Mooney, 23, was ticketed along with a relative who was watching the dog. She said that rather than register the dog as a potentially dangerous animal—which involves an insurance bond, fees, kennel requirements and more—she would have the dog put down. Police reports indicate that the dog bit two other dogs about two weeks ago. Mooney has been ticketed for both incidents.

This is the second such incident in Minneapolis this month—seven-year-old Zach King Jr. was attacked and killed in his home last week by his family’s pit bull—fueling the debate over banning pit bulls and other “dangerous breeds” in some communities. Since 1966, there have been four other deaths from dog attacks in Minnesota, all but one of which were of children seven-years-old or younger.

Canadian Conservatives vow to defend Arctic sovereignty

The Conservative Party of Canada leader Stephen Harper today made bold claims about the Canadian Arctic region at a campaign stop in Winnipeg, “The single most important duty of the federal government is to protect and defend our national sovereignty.” . The prime minister-hopeful stated, “There are new and disturbing reports of American nuclear submarines passing though Canadian waters without obtaining the permission of —or even notifying — the Canadian government.”

Harper promised a significant increase in military presence in the Canadian region, which has had notable soveriegnty disputes with the United States, Russia, Denmark and Norway.”You don’t defend national sovereignty with flags,” Harper said. “You need forces on the ground, ships in the sea, and proper surveillance.”

Among other promises, Harper stated he would station three armed naval heavy ice breakers in the area of Iqaluit with 500 regular force personnel, recruit 500 more Canadian rangers, and build a new army training center in the area of Cambridge Bay on the Northwest Passage.File:Stephen Harper voa.jpg

“As prime minister, I will make it clear to foreign governments — including the United States — that naval vessels traveling in Canadian territorial waters will require the consent of the government of Canada,” Harper stated.

The Conservative Party Website states this ““Canada First” Northern Strategy will increase surveillance, navy, army and air force presence”.

The Liberal Party of Canada, the Conservatives’ most powerful rival in the election, quickly posted a rebuttal on their website. They claim Stephen Harpers stated defense budget of $5.3(CAD) billion over 5 years is not enough to afford the two polar icebreakers, which the Liberal party claims will cost $3(CAD) billion with the party estimating an upkeep of $150(CAD) million per year. “Where does Mr. Harper plan to find another $1 billion?” the party asked in their rebuttal.

The Arctic may be an important issue in the future for Canadians, as scientists expect the fabled Northwest Passage of the Arctic to open up for year round shipping by 2050 as a result of global warming. According to the online encyclopedia Wikipedia, trade routes from Europe to the Far East could save 4000 km through the passage, as compared to the current routes through the Panama Canal.

Canada last flexed its muscle in the Arctic in 2004 in its most massive Arctic exercise ever, with six hundred personnel from the three services (army, air force, navy) involved in a large exercise in the Baffin Islands.

Canadians are scheduled to go to the polls on January 23, 2006 in an early election as a result of a non-confidence motion in parliament against the former ruling Liberal party.

Blow out sales prices likely on mattresses as new U.S. fire-resistant standards take effect

If you are in the market for new bedding, and not too concerned with the new United States guidelines for mattress fire resistance, now might be a good time to buy. Mattresses sold in the U.S. must meet new federal guidelines for flammability starting on July 1.

The peak heat release rate is limited to 200 kW during a 30 minute test. The total heat release is limited to 15 MJ within the first 10 minutes.”

The flammability of mattress sets sold in the U.S. is subject to a new mandatory federal regulation requirement passed by the Consumer Product Safety Commission (CPSC) on February 16 last year. The requirement, costing mattress manufacturers an estimated $100 million to meet, is scheduled to take effect on July 1. The commission anticipates that the new standards will save 270 lives and 1,330 injuries per year from mattress fires.

“We’ve passed a new open flame regulation and the whole idea behind the regulation is to make sure that if a mattress catches on fire that the fire burns slowly enough that people have enough time to get out of the house and get away,” said Hal Stratton, chairman of the CPSC

Radio and TV advertising spots are reacting to the new regulation by discounting prices on mattresses that fail to meet the new guidelines. Sales made in the mattress industry, like the automobile industry, are highly negotiable on price. The new regulation does not appear to have much “teeth” for mattresses already in the distribution pipeline, but it is a new law that is a bargaining position for potential buyers.

190 dead in Ethiopia floods

At least 190 people have been confirmed dead after heavy rains caused a river to burst its banks in the eastern Ethiopian city of Dire Dawa. A further 300 are reported missing.

Rescuers have been digging all weekend with just hand tools and garden equipment, although bulldozers have also been used to shift tons of mud. Disaster management teams are expected to reach the city today.

The river Dechatu flooded on Saturday night after exceptionally heavy rains. Over 200 homes were destroyed and many died instantly as their houses were swept away as they slept. Of the confirmed dead so far, nearly 40 were children.

94 people injured in the immediate aftermath were treated in hospital before returning to the remains of their homes.

Regional police inspector Beniam Fikru said that some of the dead were already being buried, but identifying bodies was difficult. “Relatives are reporting that 300 people are missing,” he said, “but the search goes on.”

Dire Dawa, 500km east of the capital Addis Ababa, is the country’s second largest city. While the death toll is expected to rise, over 15,000 people had been displaced from the city’s 250,000-strong population. On Friday, over 1,000 people were rescued from villages as rains swept through the south of the country.

Flooding is a regular occurrence in the June-August rainy season and Dire Dawa has been struck before. 45 people were killed in the city in flash floods last summer, some reportedly by crocodiles in the floodwaters.
